Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by KYLE A. HOPSON and LAURA SCOTT HOPSON, husband and wife, on the 13th day of July 2015, to 21ST MORTGAGE CORPORATION, as recorded in OFFR Book 2015, Page 2242, in the office of the Probate Judge of Marion County, Alabama; 21ST MORTGAGE CORPORATION, as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, 21ST MORTGAGE CORPORATION, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Hamilton, Marion County, Alabama, during the legal hours of sale on October 29, 2026, the following described real and personal property situated in Marion County, Alabama, to-wit:
A 1.00 acre tract of land situated in the Southwest 1/4 of the Northwest 1/4 of Section 29, Township 10 South, Range 14 West, Marion County, Alabama, being more particularly described as follows: Commence at the purported Southwest corner of the Southwest 1/4 of Northwest 1/4 of Section 29, Township 10 South, Range 14 West, thence run N 02°18’00” W along the Westerly boundary of said SW 1/4 of NW 1/4 a distance of 464.26 feet to its intersection with the Northerly right-of-way of U.S. Highway Number 78; thence run S 62°56’00” E, along the Northerly right-of-way of said highway, a distance of 968.00 feet; thence run N 02°18’00” W parallel to the Westerly boundary of above said SW 1/4 of NW 1/4 and along the Easterly boundary of the William J. Cox and Helen Cox tract of land as recorded in the Office of Judge of Probate of above said county and state, in Volume of Deeds 161 at Page 335, and the extension thereof, a distance of 216.12 feet; thence run S 62°56’00” E, and parallel to the above said highway, along the Southerly boundary of the Darrel Ray and Shelia Ray tract of land, as recorded in the said Office of Judge of Probate in Volume of Deeds 237 at Page 70, a distance of 50.00 feet; thence run N 02°18’00” W, and parallel to the Westerly boundary of above said SW 1/4 of NW 1/4, along the Easterly boundary of the Ray tract of land, a distance of 314.00 feet to an angle iron corner found; thence run S 62°56’00” E and parallel to the above said Highway Number 78 a distance of 57.07 feet to a capped 1/2 inch rebar stamped Lindley 20040 set on the Easterly indicated right-of-way of Dare Road, a paved City of Hamilton street having a total right-of-way of 40 feet, said rebar being the Point of Beginning of the tract of land herein described, to-wit; thence run N 02°22’23” W, along the Easterly right-of-way of said Dare Road, a distance of 225.00 feet to a capped 1/2 inch rebar stamped Lindley 20040; thence run S 62°56’00” E, and parallel to the above said Highway Number 78, a distance of 225.00 feet to a capped 1/2 inch rebar stamped Lindley 20040; thence run S 02°22’23” E a distance of 225.00 feet to the Northerly boundary of the Family Worship Center, Inc., tract of land to a capped 1/2 inch rebar stamped Lindley 20040; thence run N 62°56’00” W, parallel to the above said Highway Number 78 and along the Northerly boundary of said Family Worship Center, Inc., tract of land a distance of 225.00 feet to the point of beginning.
INCLUDING a security interest in one (1) 2016 Platinum 72’ x 32’ manufactured home, Serial No. PHAL03768AB;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
