Pursuant to Section 9-16-70 et seq., Alabama Code, 1975, Best Coal, Inc., Buttahatchee Mine No. 1, hereby gives notice that it has filed a Phase II bond release application with the Alabama Surface Mining Commission for release of performance bond for Permit P-3893-49-23-S, Increment No. 2 and a Phase I & II release for Increments 6 & 7. The area of land for which bond release is requested consists of 195.0 acres in Increment 2, 21.0 acres in Increment 6 and 9.0 acres in Increment 7, located in: SW/SE & SE/SW of Section 35; in Township 10 South, Range 11 West, NW/SW & SW/NW of Section 1; SE/NE, SW/NE, NW/NE, NE/SE, NW/SE, NE/SW, SE/SW, SW/SW, NW/SW, NE/NW, SE/NW, SW/NW, & NW/NW of Section 2; NE/NE, SE/NE, & NE/SE of Section 3; all in Township 11 South, Range 11 West, Marion County, Alabama. The permittee maintains that as of 10/11/21, all requirements including, replacing all topsoil or its approved substitute and re-vegetation of the area in Increment No. 2 and all requirements involving backfilling, re-grading, drainage control, replacing all topsoil or its approved substitute and re-vegetation of the area of the area in Increments 6 & 7, has been completed in compliance with State Law and Regulations and the approved reclamation plan. The permittee, therefore, is requesting release of $216,651.00 of the performance bond $314,151.00 for Increment 2, $38,950.00 of the performance bond $49,450.00 for Increment 6 and $36,900.00 of the performance bond $41,400.00 for Increment 7.
