Default having been made of the terms of the loan documents secured by that certain mortgage executed by Jarad Benton A Single Man to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for CMG Mortgage, Inc. dba CMG Financial, its successors and assigns dated January 17, 2020; said mortgage being recorded on January 21, 2020, in Book 2020, Page 207 in the Office of the Judge of Probate of Marion County, Alabama. Said Mortgage was last sold, assigned and transferred to AmeriHome Mortgage Company, LLC by assignment recorded in Deed Book 2022, Page 2864 in the Office of the Judge of Probate of Marion County, Alabama. The undersigned, AmeriHome Mortgage Company, LLC, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Marion County, Alabama during the legal hours of sale (between 11am and 4pm), on the 12th day of May, 2022 the following property, situated in Marion County, Alabama, to-wit: Lots 1 and 2 of Block 50 of the Town of Guin, Marion County, Alabama, described as follows; Commence at a rebar set at the Southeast corner of Lot 1, also being the North and Western intersection of 12th Avenue East and 9th Street; thence run West along the North right-of-way of 12th Ave. for a distance of 200.34 feet to a point in a paved driveway, also being the Southwest corner of Lot 2; thence turn with an interior angle left of 88’ 25' 34" for a distance of 202.80 feet to a rebar set in the center line of a ditch; thence continue along said line for a distance of 49.30 feet to a capped rebar set at the Northwest corner of Lot 2; thence turn with an interior angle left of 80’ for a distance of 207.37 feet to the Northeast corner of Lot 1, also being a ditch, and on the West right-of-way of 9th Street, thence turn with an interior angle left and along said right-of-way, 98’ 01' 17" for a distance of 213.49 feet to the point of beginning. Said property is commonly known as 259 12th Avenue East, Guin, AL 35563. Should a conflict arise between the property address and the legal description the legal description will control. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale. AMENDMENT TO NOTICE OF MORTGAGE FORECLOSURE SALE
The sale date under the above mentioned Notice of Mortgage Foreclosure Sale has been postponed until September 1, 2022, and public notice thereof having been given, the above notice is hereby republished with this amendment.
