MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on the 5th day of December, 1997, by Jack W. Loden and Joan M. Loden, husband and wife, as mortgagors in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge of Probate, Marion County, Alabama, in Book 590 at Page 208; and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank and Trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the West door of the Courthouse in Hamilton, Marion County, Alabama, during the legal hours of sale, on June 1, 2026, the following described real estate, together with hereditaments and appurtenances there unto belonging and all fixtures now attached to and used in connection with the premises herein described, to-wit:
TRACT 1: A tract of land situated in the SW 1/4 of NE 1/4 of Section 2, Township 11 South, Range 14 West, Marion County, Alabama, more particularly described as follows, to-wit: "Beginning at the Southwest corner of the NW 1/4 of SE 1/4 of said Section 2, and run North a distance of 1,018 feet; thence run East a distance of 453 feet; thence run North 29° 25 minutes East a distance of 460 feet to a stake located on the East side of a street at the intersection of the North water line of a lake with the East side of said street, which said stake is the point of beginning of the land herein described; thence run North 54° 00 minutes East, along the East side of said street, a distance of 300 feet; thence run South 57° 00 minutes East, along the South side of said street, a distance of 300 feet; thence run South 54° 00 minutes West, parallel with the East side of said street, a distance of 300 feet to the North water line of said lake; thence run North 57° 00 minutes West, meandering along the said Water line, a distance of approximately 300 feet to the point of beginning of the land herein described."
TRACT 2: The Southeast ¼ of Southwest ¼; the Southwest 1/2 of West 1/2 of Northeast 1/4 of Southwest 1/4, Section 10, Township 11 South, Range 13 West, Marion County, Alabama.
Said property will be sold on an "as is, where is" basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure. This sale is subject to postponement or cancellation and you should contact Diane Haden Henderson prior to attendance.
