Default having being made in the payment of the indebtedness secured by that certain mortgage dated May 10, 2023 executed by Donald Dean Hawkins, a married man, in favor of Mortgage Electronic Registration Systems, Inc., solely as a nominee for LeaderOne Financial Corporation, said Mortgage being recorded May 16, 2023, in Book 2023, Page 5719, in the Office of the Judge of Probate of Marion County, Alabama; having later been assigned to Planet Home Lending, LLC by instrument recorded in Book 2025, Page 7837, in the Office of the Judge of Probate of Marion County, Alabama. Said default continues and notice is hereby given that the undersigned, Planet Home Lending, LLC, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash at the main entrance to the County Courthouse, Marion County, Alabama on 08/14/2025, during the legal hours of sale, the following described real estate situated in Marion County, Alabama, to-wit:
A tract of land situated in the Southwest 1/4 of Southwest 1/4 of Section 2, Township 11 South, Range 14 West, Marion County, Alabama, and being more particularly described as follows: Commence at the Southwest corner of the Southwest 1/4 of Southwest 1/4 of Section 2, Township 11 South, Range 14 West and run East along the Southerly boundary of said SW 1/4 of SW 1/4 a distance of 482.61 feet to a point situated on the Southerly right-of-way of a City of Hamilton Street; thence run N. 07 degrees 56 minutes 36 seconds W., a distance of 30.29 feet to the Northerly right-of-way of a City of Hamilton Street, to a capped 1/2 inch solid pin; thence run N. 89 degrees 59 minutes 40 seconds E., along the Northerly right-of-way of said street, a distance of 169.35 feet to a capped 1/2 inch solid pin, said pin being the point of beginning of the tract herein described, to-wit; thence run N. 35 degrees 39 minutes 29 seconds E., a distance of 170.11 feet to the Westerly right-of-way of the above said street to a capped 1/2 inch solid pin; thence run S. 32 degrees 15 minutes 17seconds E., along the Westerly right-of-way of said street a distance of 6.86 feet to the point of curvature; thence continue along the Westerly right-of-way of said street along the arc of a curve to the right, having a radius of 79.83 feet, chord bearing of S. 00 degrees 52 minutes 09 seconds W., a chord distance of 87.24 feet to a right-of-way change, to a capped 1/2 inch solid pin; thence run S. 56 degrees 00 minutes 32 seconds E., along the Westerly right-of-way of said street a distance of 10.00 feet to a point; thence continue along the Westerly right-of-way of said street, along the arc of a curve to the right having a radius of 89.83 feet, a chord bearing of S. 62 degrees 00 minutes 12 seconds W., a chord distance of 84.36 feet to the point of tangency; thence continue along the Northerly right-of-way of said street, S. 89 degrees 59 minutes 40 seconds W., a distance of 35.31 feet to the point of beginning.
SUBJECT TO a ten foot (10) wide sanitary sewer maintenance easement, being five feet (5) on either side of the center of the pipe in place situated about the center of the herein above described tract.
ALSO SUBJECT TO a high voltage power transmission service line easement across a portion of the Northerly side of the herein above described tract.
