To the Honorable Paige Vick, Judge Probate Court, Marion County, Alabama:
The petition of the undersigned respectfully represents that Frances R. West died in Russellville, Franklin County, Alabama, on or about the 8th day of April, 2022, leaving no will, so far as your petitioners know or believe and that decedent’s death was known more than five days before this day, and this petition further shows that: • The said decedent was, at the time of death domiciled in Marion County, Alabama and died with certain retirement benefits that were earned prior to death and certain monies held in a Qualified Income Trust. These amounts are less than $32,047, the 2022 adjusted amount set forth in Section 43-2-692 (b)(1) of the Code of Alabama. • The sole purpose of this Petition is to allow the funds to be distributed to the decedent’s heirs. • The decedent did not have debts, outside of the costs of the funeral, which have been paid. • Notice of this Petition will be filed with the Journal Record for one week. • No petition to probate the decedent’s estate has been filed. Your petitioners, Jeremy West and Amy West Cannon, being the remaining heirs of said decedent, own property in the State of Alabama, nineteen or more years of age, and are not disqualified under the law from serving as a personal representative, believe that said estate should be summarily distributed to effectuate the payment of these funds, do therefore, by virtue of their right under the statute, pray that your Honor will grant this Petition for Summary Distribution on the Estate of Frances R. West.
