Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by BRANDY NICOLE FROST GWIN and JEREMY MICHAEL GWIN, a married couple, on the 5th day of May 2023, to VANDERBILT MORTGAGE AND FINANCE, INC., as recorded in OFFR Book 2023, Page 5499, in the office of the Probate Judge of Marion County, Alabama; VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Hamilton, Marion County, Alabama, during the legal hours of sale on February 28, 2024, the following described real and personal property situated in Marion County, Alabama, to-wit:
A tract of land being in and a part of the SE 1/4 of NE 1/4, Section 20, Township 12 South, Range 13 West, Marion County, Alabama and being more particularly described as follows: Commencing at the Northeast corner of the SE 1/4 of NE 1/4, Section 20, Township 12 South, Range 13 West, Marion County, Alabama and a 1/2” capped rebar; thence run N88°13’19”W along the North line of said SE 1/4 of NE 1/4 for a distance of 200.33 feet to a 1/2” rebar and the point of beginning; FROM SAID POINT OF BEGINNING run S13°38’44”W for a distance of 365.83 feet to the center of County Highway 54 (30 foot right-of-way indicated) and a railroad spike; thence run along said center line along the following bearings and distances: N77°51’52”W for a distance of 64.80 feet, N81°27’50”W for a distance of 221.27 feet, N74°23’36”W for a distance of 109.87 feet, N59°26’25”W for a distance of 54.87 feet, N51°51’36”W for a distance of 157.91 feet, N54°22’29”W for a distance of 112.60 feet, N62°32’55”W for a distance of 152.2 feet, N66°36’22”W for a distance of 42.95 feet to the center of Stinson Road (30 foot right-of-way indicated) and a mag nail; thence run along the center of said Stinson Road N20°28’28”E for a distance of 40.38 feet to a railroad spike; thence run S87°39’51”E for a distance of 898.46 feet to the point of beginning.
INCLUDING a security interest in one (1) 2023 Southern Energy manufactured home, Serial No. RUS08450AL;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
