Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by KELSEY NICOLE SWIMS and DUSTIN BUSBEE, a married couple, on the 31st day of January 2024, to 21ST MORTGAGE CORPORATION, as recorded in OFFR Book 2024, Page 1078, in the office of the Probate Judge of Marion County, Alabama; 21ST MORTGAGE CORPORATION, as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, 21ST MORTGAGE CORPORATION, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Hamilton, Marion County, Alabama, during the legal hours of sale on April 15, 2026, the following described real and personal property situated in Marion County, Alabama, to-wit:
A parcel of land located in the SW 1/4 of the NW 1/4 of Section 6, Township 11 South, Range 11 West, Marion County, Alabama, being more particularly described as follows:
Commence at the NW corner of said Section 6, being a found rock corner, and run S89°09’14”E along section line 917.00 feet; thence leaving section line S00°50’46”W 1572.71 feet to a set capped rebar (Long CA50221) on the Easterly right-of-way of Alabama Highway 241, being the Point of Beginning of the herein described parcel; thence along right-of-way the following: with a curve turning to the left with an arc length of 194.32 feet, with a radius of 2790.54 feet, with a chord bearing of S00°38’44”W with a chord length of 194.28 feet to a found concrete monument; thence S34°26’22”E 46.55 feet to a found concrete monument; thence S16°16’10”E 109.26 feet to a found concrete monument; thence S04°06’42”E 46.86 feet to a set capped rebar (Long CA50221); thence leaving right-of-way S84°14’14”E 193.17 feet to a found capped rebar (Loden); thence continue S84°14’14”E 32.05 feet to a point on the West bank of the Buttahatchie River; thence along West bank the following: N17°47’58”W 113.88 feet; thence N13°49’09”W 77.67 feet; thence N05°19’52”W 57.08 feet; thence N10°22’44”E 55.98 feet; thence N39°05’04”E 94.80 feet; thence N49°37’16”E 50.40 feet to a set capped rebar (Long CA50221); thence leaving said Buttahatchie River bank N89°09’14”W 331.81 feet to the Point of Beginning.
INCLUDING a security interest in one (1) 2022 Champion 76’ x 28’ manufactured home, Serial No. 020000HA004191AB;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
