Default having been made in the payment of the debt secured by that certain mortgage executed by Shirley V. Burt, Mortgagor(s), to Mortgage Electronic Registration Systems, Inc. as nominee for Genworth Financial Home Equity Access, Inc., Mortgagee, on March 14, 2011, said mortgage being recorded on March 23, 2011 in the Probate Office of Marion County, Alabama in Instrument Number 94864, Book 2011, Page 990, and later assigned to LLACG COMMUNITY INVESTMENT FUND, by reason of such default, having declared all the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, LLACG COMMUNITY INVESTMENT FUND will sell at public outcry, for cash, to the highest bidder, in front of the Courthouse door in the City of Hamilton, Marion County, Alabama during the legal hours of sale on January 12, 2024 the following described real estate situated in Marion County, Alabama, to wit:
The land described herein is situated in the state of Alabama, County of Marion, City of Hamilton, and is described as follows:
A tract of land containing 1.1 acres, more or less lying in the SE 1/2 of SE 1/4 Section 36, Township 10 South, Range 14 West, Marion County, Alabama, more particularly described as: Beginning at an iron pin located 171 feet East of and 21 feet South of the Northwest corner of the SE 1/4 of SE 1/4 of said Section 36, said iron pin located on the Southeast side of a street and drive; thence North 88 degrees 00 minutes West and along said street a distance of 155 feet to an iron pin; thence continuing South 52 degrees 00 minutes West and along the Southeast side of said street a distance of 45 feet to an iron pin; thence South 18 degrees 00 minutes West and continuing along said Southeast side of said street 210 feet to an iron pin; thence South 01 degree 00 minutes West and along the East side of said street a distance of 65 feet to an iron pin; thence North 65 degrees 24 minutes East a distance of 272 feet to an iron pin; thence North 03 degrees 00 minutes East a distance of 174 feet to the Point of beginning. Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage to LLACG COMMUNITY INVESTMENT FUND, Mortgagee, and the proceeds thereof will be applied as provided for in the terms of said mortgage.

McMichael Taylor Gray, LLC reserves the right to award the bid to the next highest bidder should the highest bidder fail to timely tender the total amount due. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
