Default having been made on the terms of that certain mortgage executed by Ad-Media Management Corporation, an Alabama corporation, to First National Bank, Hamilton, on the 6th day of August, 2007, and recorded in Volume 2007 of Mortgages at Page 1506 in the Office of Judge of Probate of Marion County, Alabama, and default still continuing and by virtue of the power of sale contained in said mortgage, the following described real estate situated in the County of Marion, State of Alabama, will be sold at public auction to the highest bidder for cash at the Main Entrance of the Courthouse of Marion County, Alabama, during the legal hours of sale on the 22nd day of December, 2023.
Tract I
A 10.0 acre tract of land situated in the Northwest ¼ of the Northeast ¼ of Section 9, Township 12 South, Range 12 West, Marion County, Alabama, and being more particularly described as follows: “Beginning at the Southwest corner of the Northwest ¼ of Northeast ¼ of Section 9, Township 12 South, Range 12 West, to-wit, thence run N.02°46’W., along the Westerly boundary of said NW ¼ - NE ¼ a distance of 660.0 feet to an iron pipe set; thence run N.88°51’E., and parallel to the Southerly boundary of said NW ¼ - NE ¼ a distance of 660.0 feet to an iron pipe set; thence run S.02°46’E., and parallel to the Westerly boundary of said NW ¼ - NE ¼ a distance of 660.00 feet to the Southerly boundary of said NW ¼ - NE ¼ to an iron pipe; thence run S.88°51’W., along the Southerly boundary of said NW ¼ - NE ¼ a distance of 660.00 feet to the point of beginning.
Tract II
A triangular tract of land described as: Beginning at a point that is 360 feet North of and 340 feet West of the SE corner of the NW ¼ of NE ¼, Section 16, Township 13 South, Range 12 West. Also said beginning point located on the North side of a street and in the center of drainage ditch; thence Northwesterly and along said drainage ditch, a distance of 103 feet to the center of an old dam; thence Southwesterly and along the center of said dam, a distance of 117 feet to the North side of said street; thence Easterly and along said street, a distance of 130 feet to the point of beginning. Also all that part that lies North of a street and South of an old mill race and West of an old dam and East of Gas line. All of above described land lying and being situated in the NW ¼ of NE ¼, Section 16, Township 13 South, Range 12 West.
Tract III
Beginning at a point located on the South right-of-way line of the Frisco Railway where the East boundary line of the NW ¼ of NE ¼ of Section 16, Township 13 South, Range 12 West crosses said right-of-way line; thence Westerly and along said right-of-way line, a distance of 460 feet to a 6” gas concrete marker; thence Southerly and along gas line, a distance of 375 feet to an old mill race; thence Easterly and along said old mill race, a distance of 200 feet to the center of old dam; thence Easterly and along the center of said old dam, a distance of 350 feet to where said dam intersects a drainage ditch; thence continuing Easterly and along said drainage ditch, a distance of 125 feet to the said East boundary line of the NW ¼ of NE ¼, Section 16, Township 13 South, Range 12 West; thence North and along said East boundary line a distance of 75 feet, more or less, to the point of beginning, lying and being situated in the NW ¼ - NE ¼, Section 16, Township 13 South, Range 12 West, Marion County, Alabama.
Tract IV
Also being at the above described 6” gas line marker; thence Westerly, along the Southerly right-of-way of Frisco Railroad, for a distance of 75 feet; thence Southerly and parallel with gas line above mentioned to old mill race; thence Southeasterly, and along old mill race, to said gas line; thence along gas line in a Northerly direction to point of beginning, less and except a strip 25 feet wide off of the Northerly side of said 75 foot strip. Lying and being in the NW ¼ of NE ¼, Section 16, Township 13 South, Range 12 West. A road right-of-way 12 feet wide is reserved adjoining the said railroad right-of-way.
THIS PROPERTY WILL BE SOLD ON AN "AS IS, WHERE IS" BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made for the purpose of paying the mortgage indebtedness and costs of foreclosure.
