NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made under the terms of that certain Mortgage (with Security Agreement and Assignment of Rents and Leases) (the “Mortgage”) dated January 22, 2020 executed by Shashikant Patel, President for JSKFD, Inc., an Alabama corporation (the “Mortgagor”), and recorded in Book 2020, Page 307 in the Office of the Judge of Probate of Marion County, Alabama (the “Probate Court”), the undersigned, under and by virtue of the power of sale contained in the said mortgage and as authorized under Alabama law pursuant to §§ 35-10-1, et seq. of the Alabama Code, will sell at public outcry to the highest bidder for cash in front of the main entrance of the Marion County Courthouse in Hamilton, Alabama, on July 14, 2025 during the legal hours of sale the following real estate situated in Marion County, Alabama, to wit (the “Real Property”):
Commencing at the purported Southwest corner of the Northeast Quarter of the Southwest Quarter of Section 34 Township 12 South, Range 13 West, Marion County, Alabama; thence East 924.00 feet; thence South 124.0’ to an existing Iron pin on the northeast ROW of Highway 43 (paved 100’ ROW); the point of beginning of the property herein to be described; thence North 62° 36’ East along the Northeast ROW 421.30 feet to an existing Iron pin; thence North 27°25’ East 315.19 feet to an existing axle on a fence; thence North 62°37’ West 421.51 feet to an existing Iron pin; thence South 27°23’ West 315.04 feet to the point of beginning, and being a part of the Northeast Quarter of the Southwest Quarter, the Northwest Quarter of the Southeast Quarter and the Southeast Quarter of the Southwest Quarter Section 34, Township 12 South, Range 13 West, Marion County, Alabama, according map or plat of Herbert C, Miller, Jr., Ala. Reg. No. 18981, dated October 30, 2019, and revised November 18, 2019.
TOGETHER WITH all of Mortgagor’s tangible personal property and fixtures located at the Real Property, pursuant to Alabama Code § 7-9A-604, as evidenced by that (i) Security Agreement (the “Security Agreement”), dated January 22, 2020 by and between Mortgagor and The MINT National Bank (the “Bank”); and (ii) the UCC Financing Statement and its amendments and attachments filed with the Alabama Secretary of State on February 10, 2020 at Filing Number 20-0068939.
This sale is made for the purpose of paying the indebtedness secured by the aforementioned Mortgage, as well as the expenses of foreclosure.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. The property is sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the records of the Office of the Judge of Probate of Marion County, Alabama. This property will be sold without warranty or recourse, expressed or implied as to title, use, and/or enjoyment, and will be sold subject to the right of redemption of all parties entitled thereto.
The undersigned reserves the right to bid for and purchase the property and to credit its purchase price against the expenses of sale and the indebtedness secured by the property. This sale is subject to postponement or cancelation.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances.
