NOTICE OF SALE

Default having been made on the terms of that certain mortgage executed by Robert L. Holcomb AKA Robert Lee Holcomb and Kelly Holcomb AKA Kelly Bannister Holcomb AKA Kelly Bannister AKA Kelly Louise Holcomb AKA Kelly Louise Baninster [sic] Holcomb, a married couple, to First National Bank on the 28th day of September, 2022, and recorded in Mortgage Book 2022, Page 13588, Instrument Number 184416 in the Office of Judge of Probate of Marion County, Alabama, and default still continuing and by virtue of the power of sale contained in said mortgage, the following described real estate situated in the County of Marion, State of Alabama, will be sold at public auction to the highest bidder for cash at the Main Entrance of the Courthouse of Marion County, Alabama, during the legal hours of sale on the 3rd day of July, 2025.
Lot No. 9, Lot No. 10, and Lot No. 11 of the Forest Hills Subdivision, as recorded in Map Book 2 at Page 61 (presently Map Cabinet A, Slide 33), in the Office of the Judge of Probate of Marion County, Alabama. ALSO: A tract of land situated in the Southwest ¼ of Northeast ¼ of Section 27, Township 10 South, Range 14 West, Marion County, Alabama and being more particularly described as follows: Beginning at the Southwest corner of Lot Number 11 of the Foresthill Subdivision, Marion County, Alabama; thence run East, a distance of 229.64 feet to a point; thence run South, an approximate distance of 232 feet to a point on the North right-of-way line of Southvale Avenue, thence run West along the North right-of-way of Southvale Avenue, a distance of 86.19 feet, continue West along the right-of-way line of Southvale Avenue, a distance of 55.76 feet, continue West, a distance of 98.78 feet to a point, thence run North approximately 247 feet to the point of beginning of the land described.
THIS PROPERTY WILL BE SOLD ON AN "AS IS, WHERE IS" BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made for the purpose of paying the mortgage indebtedness and costs of foreclosure.
