MORTGAGE FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on the 24th day of April, 2019, by BRADLEY WILLIAM ESTES, an unmarried man, and TYRENA KAY NEWELL, an unmarried woman, as mortgagors in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge of Probate, Marion County, Alabama, in OFFR Book 2019 at Page 1648, and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank and Trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the West door of the Courthouse in Hamilton, Marion County, Alabama, during the legal hours of sale, on NOVEMBER 10, 2025, the following described real estate, together with hereditaments and appurtenances there unto belonging and all fixtures now attached to and used in connection with the premises herein described, to-wit: A tract of land situated in the NW 1⁄4 of NE 1⁄4 of Section 24, Township 10 South, Range 16 West, Marion County, Alabama, more particularly described as follows, to-wit: "Commencing at the Northwest corner of said NW 1⁄4 of NE 1⁄4, which said corner is marked by an old grader blade; thence run North 88° 51 minutes East, along the North boundary of said NW 1⁄4 of NE 1⁄4, a distance of 610.22 feet to a one half inch capped rebar located on the Easterly right-of-way of a Marion County paved road, which said rebar is the point of beginning of the tract of land herein described; thence continue North 88° 51 minutes East, along the North boundary of said NW 1⁄4 of NE 1⁄4, a distance of 125.30 feet to a one half inch capped rebar; thence run South 01° 32 minutes West a distance of 276.96 feet to a one half inch capped rebar located in the center of a gravel road; thence run South 88° 32 minutes West, along the center of said gravel road, a distance of 63.67 feet to a one half inch capped rebar; thence run North 86° 43 minutes west, continuing along the centerline of said gravel road, a distance of 124.03 feet to a one half inch capped rebar located on the Easterly right-of-way of said Marion County paved road; thence run North 20° 42 minutes East, along the Easterly right-of-way of said paved road, a distance of 50.75 feet to a P.I. point; thence run North 13° 08 minutes East, continuing along the Easterly right-of-way of said paved road, a distance of 227.34 feet to the point of beginning of the tract of land herein described;" Subject to a 20.00 foot wide easement, for the purpose of ingress and egress, along an existing gravel road, which said road runs along the entire Southerly boundary of the tract of land herein above described.
Said property will be sold on an "as is, where is" basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above-described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure.
