Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by DANA JONES A/K/A DANA L. JONES A/K/A DANA LESHAY JONES, and JUSTIN COLBURN A/K/A JUSTIN T. COLBURN A/K/A JUSTIN TAYLOR COLBURN A/K/A JUSTIN TAYLOR JUNIOR COLBURN, a married couple, on the 9th day of February 2024, to FIRSTBANK, as recorded in OFFR Book 2024, Page 2875, in the office of the Probate Judge of Marion County, Alabama; FIRSTBANK, as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, FIRSTBANK, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Hamilton, Marion County, Alabama, during the legal hours of sale on April 2, 2026, the following described real and personal property situated in Marion County, Alabama, to-wit:
A parcel of land located in the SE 1/4 of the NW 1/4 of Section 36, Township 9 South, Range 16 West, Marion County, Alabama, being more particularly described as follows:
Commence at the SE corner of the SE 1/4 of the NE 1/4 of said Section 36, said point being a 1” rebar, and run N86°15’04”W along 1/4 – 1/4 line 3709.04 feet to a set capped rebar (Long CA50221), said point being the Point of Beginning of the herein described parcel; thence continue along 1/4 – 1/4 line N86°15’04”W 278.39 feet to a set capped rebar (Long CA50221) at the SW corner of said SE 1/4 of the NW 1/4, said 1/4 – 1/4 line runs along the North meanderings of Downs Road (prescriptive right-of-way indicated); thence leaving 1/4 – 1/4 line N34°10’46”E 454.00 feet to a set capped rebar (Long CA50221); thence S72°49’14”E 245.00 feet to a set capped rebar (Long CA50221); thence S33°19’27”W 384.67 feet to the Point of Beginning.
According to that certain survey by Andrew D. Long, Alabama Registration No. 40145, dated 9/29/2023.
Being one and the same as the tract of land described in Volume 2023, Page 10408.
INCLUDING a security interest in one (1) 2024 Hamilton 70’ x 14’ manufactured home, Serial No. HH24AL19292;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
