Default having been made of the terms of the loan documents secured by that certain mortgage executed by Steven T Hood And Lerhea T Hood Husband And Wife to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Listerhill Credit Union, its successors and assigns dated June 1, 2017; said mortgage being recorded on June 9, 2017, in Book 2017, Page 2028 in the Office of the Judge of Probate of Marion County, Alabama. Said Mortgage was last sold, assigned and transferred to US BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR VRMTG ASSET TRUST by assignment recorded in Deed Book 2024, Page 14765 in the Office of the Judge of Probate of Marion County, ALABAMA.
The undersigned, US BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR VRMTG ASSET TRUST, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Marion County, Alabama during the legal hours of sale (between 11am and 4pm), on the 12th day of May, 2025 the following property, situated in Marion County, Alabama, to-wit:
A tract of land situated in the N 1/2 of NE 1/4 of Section 6, T10S, R13W Marion County, Alabama, being more particularly described as follows: Commence at the NE corner of the N 1/2 of NE 1/4 of Section 6, T10S, R13W, said corner being marked by a 1/2 inch rebar and a large rock that's been destroyed, thence run N 85 degrees 33 minutes 8 seconds W along the northerly boundary of said N 1/2 of NE 1/4, a distance of 1155.00 feet, to a 1/2 inch capped rebar found situated at the centerline of a graveled road, said rebar being the point of beginning of the tract of land described herein to-wit; thence run the following consecutive chord bearings and distances along the meander of the centerline of said old road, (S 27 degrees 58 minutes 19 seconds, a distance of 104.51 feet; S 29 degrees 30 minutes 12 seconds W a distance of 69.94 feet; S 18 degrees 11 minutes 30 seconds W, a distance of 61.95 feet; 01 degrees 03 minutes 40 seconds W a distance of 133.67 feet; S 14 degrees 59 minutes 09 seconds W a distance of 108.33 feet; S 38 degrees 03 minutes 49 seconds W a distance of 111.44 feet; S 59 degrees 03 minutes 26 seconds W, a distance of 115.04 feet; S 41 degrees 20 minutes 00 seconds W, a distance of 85.60 feet; S 85 degrees 20 minutes 04 seconds W, a distance of 175.21 feet; N 79 degrees 42 minutes 44 seconds W, a distance of 48.63 feet; S 74 degrees 34 minutes 59 seconds W, a distance of 47.52 feet; S 78 degrees 00 minutes 25 seconds W, a distance of 122.03 feet) to a capped 1/2 inch rebar and steel post; thence run N 38 degrees 18 minutes 14 seconds E, a distance of 367.94 feet, to a 1/2 inch capped rebar and steel post; thence run N 21 degrees 31 minutes 57 seconds E, a distance of 231.24 feet, to a capped 1/2 inch rebar; thence run N 21 degrees 47 minutes 13 seconds E, a distance of 245.38 feet, to the northerly boundary of the above said N 1/2 of NE 1/4, to a 1/2 inch capped rebar; thence run S 85 degrees 33 minutes 28 seconds E, a distance of 342.88 feet, to the point of beginning. LESS AND EXCEPT the right-of-way for Marion County Highway Number 180 across the entire northerly boundary of the herein above described tract of land. Above description taken from that certain survey prepared by P Michael Lindley dated 07/15/2013, Job #6101370.
Said property is commonly known as 379 County Highway 180, Hamilton, AL 35570.
Should a conflict arise between the property address and the legal description the legal description will control.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale.
