LEGAL NOTICE
Pursuant to Section 9-16-70 et seq., Alabama Code, 1975, Iron Eagle Land Rehabilitation, LLC, Buttahatchee Mine No. 1, hereby gives notice that it has filed a Phase III bond release application with the Alabama Surface Mining Commission for release of performance bond for Permit P-3893-49-23-S, Increment No. 2, 6 & 7. The area of land for which bond release is requested consists of 195.0 acres in Increment 2, 21.0 acres in Increment 6 and 9.0 acres in Increment 7, located in:
SW/SE & SE/SW of Section 35; in Township 10 South, Range 11 West, SW/NW & NW/SW of Section 1; SE/NE, SW/NE, NW/NE, NE/SE, NW/SE, NE/SW, SE/SW, SW/SW, NW/SW, NE/NW, SE/NW, SW/NW, & NW/NW of Section 2; NE/NE, SE/NE, & NE/SE of Section 3; all in Township 11 South, Range 11 West, Marion County, Alabama.
The permittee maintains that as of 10/03/24, all requirements involving re-grading, planting and growing times of the area has been completed in compliance with State Law and Regulations and the approved reclamation plan. The permittee, therefore, is requesting release of $97,500.00 of the performance bond $97,500.00 for Increment 2, $10,500.00 of the performance bond $10,500.00 for Increment 6 and $10,500.00 of the performance bond $10,500.00 for Increment 7.

Such requests must be received no later than December 6, 2024.
