WHEREAS, the County Commission of Marion County, Alabama, proposes that the public interest will be served by the vacation of the public highway herein described;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNTY COMMISSION OF MARION COUNTY, ALABAMA, That a public hearing shall be scheduled at the Commission Office located in the Marion County Commission Office on the 11th of September, 2023, at 9:00am for the purpose of receiving the public’s input on said vacation; and
BE IT FURTHER RESOLVED, That the Commission Chairman and County Clerk are hereby authorized and directed to publish notice of said public hearing in The Journal Record once a week for four consecutive weeks, said notice shall be substantially as follows:
On the 11th day of September, 2023, at 9:00 a.m., the Marion County Commission will hold a public hearing at the Commission Offices located at 119 Military Street North, Hamilton, Alabama, on the County’s proposal to vacate Mitchell Road more specifically described as follows:
The entirety of Mitchell Road to the North and West from County Highway 48 until said Road reaches and intersects with the Grady Cole Road.
BE IT FURTHER RESOLVED, That the Commission Chairman and County Clerk are hereby authorized and directed to post a copy of said notice on a bulletin board at the Marion County Courthouse and in the Office of the County Commission;
BE IT FURTHER RESOLVED, That the Commission Chairman and County Administrator are hereby authorized and directed to serve a copy of said notice by United States Mail, at least 30 days prior to the scheduled meeting, on any abutting owner and on any entity known to have facilities or equipment such as utility lines, both aerial or buried, within the public right-of-way of the portion of said highway proposed to be vacated.
