Default having been made in the terms of that mortgage executed on the 4th day of March, 2013, by TEMIKA THOMAS, single, as mortgagor in favor of State Bank and Trust, as mortgagee, which said mortgage is recorded in the Office of the Judge off Probate, Marion County, Alabama, in OFFR Book 2013 at page 926; and State Bank and Trust, as mortgagee, having declared all of the indebtedness secured by said mortgages due and payable and such default continuing, notice is hereby given, that acting under and by virtue of the power of sale contained in said mortgage, State Bank & trust, as mortgagee, will sell at public outcry, for cash, to the highest bidder, in front of the West door of the courthouse in Hamilton, Marion County, Alabama, during the legal hours of sale, on September 12, 2022 the following described realestate, together with hereditaments and appurtenances there unto belongings and all fixtures now attached to and used in connection with the premises herein described, to-wit:
A tact of land situated in the SW 1/4 of NW 1/4 of Section 28, Township 12 South, Range 13 West, Marion County, Alabama, more particularly described as follows, to-wit: Beginning at the Northwest corner of the said SW 1/4 of NW 1/4 and run North 83º 03 minutes East a distance of 222 feet; thence run South 75º 30 minutes East a distance of 112 feet to an iron pin located on the South right-of-way of paved street, the point of beginning of the land described; thence run South 08º 29 minutes East a distance of 210 feet to an iron pin; thence run South 64º 24 minutes East a distance of 210 feet to an iron pin; thence run South 08º 29 minutes East distance of 138 feet to an iron pin; thence run North 87º 30 minutes East a distance of 150 feet to an iron pin at the base of a pine tree; thence run North 02º 00 minutes East a distance of 243 feet to an iron pin located on the South right-of-way of said paved street; thence run North 61º 00 minutes West along the South right-of-way of said paved street a distance of 203 feet to an iron pin; thence run North 64º 24 minutes West a distance of 120 feet to an iron pin; thence run North 75º 30 minutes West a distance of 90 feet to the point of beginning of the land herein described, being the same land described in the deed, dated December 24, 1979, recorded in the Marion County Probate Judge’s Office in Deed Book 213, pages 34 and 35.
Said property will be sold on an “as is, where is” basis subject to any easements, encumbrances, and exceptions contained in said mortgage and those contained in the records of the Office of the Judge of Probate where the above- described property is situated. Said property will be sold without warranty or recourse, expressed or implied as to title, use and/pr enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the mortgage debt, cost and expense of foreclosure.
