Default having been made on the terms of those certain mortgages executed by Donna C. Thompson aka Donna J. Thompson, an unmarried woman, to First National Bank as follows: That certain mortgage executed on the 13th day of October, 2020, and recorded in Mortgage Book 2020 at Page 3817 in the Office of Judge of Probate of Marion County, Alabama, and that certain mortgage executed on the 27th day of September, 2024, and recorded in Mortgage Book 2024 at Page 11890; and default still continuing and by virtue of the power of sale contained in said mortgages, the following described real estate situated in the County of Marion, State of Alabama, will be sold at public auction to the highest bidder for cash at the Main Entrance of the Courthouse of Marion County, Alabama, during the legal hours of sale on the 3rd day of October, 2025.
A tract of land situated in the NE ¼ of SW ¼ of Section 33, Township 10 South, Range 14 West, Marion County, Alabama and being more particularly described as follows: Commence at the Southeast corner of said NE ¼ of SW ¼; thence run North 03°20 minutes West along the East boundary of said NE ¼ of SW ¼ a distance of 750.08 feet to an old angle iron pin, said angle iron being the point of beginning of the tract herein described; thence run South 85°57 minutes West as distance of 288.02 feet to an old angle iron pin situated on the Easterly right-of-way of Robin Street (40.0 foot wide right-of way); thence run the following consecutive bearings and distances along the Easterly right-of-way of said street; North 22°27 minutes West, 125.16 feet; North 00°39 minutes East, 88.32 feet; North 14°17 minutes East, 59.55 feet; North 34°,03 minutes East, 106.12 feet; North 45°40 minutes East, 33.3 feet to the Westerly side of Key Branch; continue North 45°40 minutes East, 5.0 feet to the center of said Key Branch; thence Southeasterly, meandering the downstream flow of the centerline of said Key Branch, chord distance 388.0 feet, more or less, to the East boundary of said NE ¼ of SW ¼; thence South 03°20 minutes East along said East boundary a distance of 65.0 feet to the point of beginning.
THIS PROPERTY WILL BE SOLD ON AN "AS IS, WHERE IS" BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGES AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made for the purpose of paying mortgage indebtedness and costs of foreclosure.
